These Terms of Service (hereinafter "Terms") govern the use of the "EPINCMS" (epincms.com) platform and its software services (SaaS) managed by "ATELYE" Limited Liability Company (hereinafter "Company" or "We").
By accessing our website, registering, or using our services in any form, you confirm that you have fully read, understood, and unconditionally accepted these Terms. If you do not agree with these Terms, please stop using the platform.
1. Description of Service
"EPINCMS" is a cloud-based software service that enables users (hereinafter "Customer" or "Seller") to create and manage an online store (e-commerce website) for selling digital products (game keys, e-pins, licenses, and digital codes). We provide only technical infrastructure to customers and are not the direct supplier of the products sold on the Customer's website.
2. Registration and Account Security
To use our services, you must register and create an account in the system.
- Accurate Information: All information provided during registration (name, email, phone number) must be accurate, complete, and up to date.
- Responsibility: It is your direct responsibility to maintain the confidentiality of the password used to access your account and the login credentials for the admin panel. "ATELYE" LLC is not responsible for any activities performed through your account.
- Unauthorized Access: If you notice any unauthorized use of your account, you must immediately notify us via [email protected].
3. Payments, Trial Period, and Subscription
- 7-Day Free Trial: "EPINCMS" grants newly registered users a completely free 7 (seven) day trial period to test the service. No bank card information is required at this stage.
- Subscription Commencement: After the trial period ends, users who wish to continue must select one of the paid (monthly or annual) plans and enter their payment details.
- Payment Delay: If the subscription fee is not paid on time, the Company has the right to temporarily suspend the operation of the Customer's e-commerce website with or without prior notice.
4. Prohibited Activities
Engaging in the following activities using the "EPINCMS" infrastructure is strictly prohibited. Violation of these rules will result in the immediate closure of the account without any refund:
- Illegal Products: Sale of stolen game accounts, cracked software, illegally copied intellectual property materials, and e-pins without a legal source.
- Fraud and Financial Crimes: Money laundering, selling or purchasing products using bank cards belonging to others (carding).
- Malicious Software: Uploading any virus, trojan, or malicious code to the system that could disrupt the platform's operation.
- Rights Violations: Publishing content that infringes the copyrights, trademark value, or personal privacy of third parties.
5. Intellectual Property Rights
- Our Rights: The software code, design, architecture, logos, and all other elements belonging to "ATELYE" LLC of the "EPINCMS" platform are protected by copyright. The Customer only rents the platform as a service and cannot claim any ownership rights over its source code.
- Your Rights: The products, prices, customer information, and texts uploaded by the Customer to their own e-commerce website are the Customer's own intellectual property. The Company does not claim any rights over this information.
6. Limitation of Liability
"EPINCMS" services are provided "as is" and "as available." We do not provide an absolute guarantee that the system will operate 100% uninterrupted and error-free (although we strive for maximum availability).
The Company ("ATELYE" LLC) is not directly or indirectly liable for data loss, revenue, or profit loss that the Customer may experience due to technical failures, server outages, cyberattacks, or problems originating from third-party providers.
7. Suspension and Termination of Service
- By You: You can cancel your subscription at any time from the admin panel (for detailed information, please refer to our Return & Cancellation Policy page).
- By Us: The Company has the right to immediately terminate the account if it determines that the Customer has violated these Terms, engaged in illegal activity, or failed to fulfill payment obligations.
8. Applicable Law and Dispute Resolution
These Terms are governed by and interpreted in accordance with the laws of the Republic of Azerbaijan. Any disputes must first be resolved through mutual agreement and negotiation. If no agreement is reached, disputes will be heard at the courts of the legal address where "ATELYE" LLC is registered (Republic of Azerbaijan, courts of Ganja city).
9. Changes to Terms
"ATELYE" LLC reserves the right to unilaterally make changes to these Terms at any time. Users will be notified of significant changes via email or through a notification in the admin panel. Continuing to use the platform after changes are announced constitutes acceptance of the new terms.
